1. "연구부정행위"라 함은 연구를 제안, 수행, 발표하는 과정에서 연구 목적과 무관하게 고의 또는 중대한 과실로 내용을 위조, 변조, 표절, 부당한 논문 저자표시행위 등을 말하며, 이는 다음 각 호와 같다.
   • 1)
     "위조"라 함은 존재하지 않는 연구 자료나 연구결과 등을 허위로 만들어 보고하는 행위를 말한다.
   • 2)
     "변조"라 함은 연구자료, 연구과정, 연구결과를 사실과 다르게 변경하거나 누락시켜 연구내용 또는 결과를 왜곡하는 행위를 말한다.
   • 3)
     "표절"이라 함은 타인의 아이디어, 연구과정, 연구결과 등을 적절한 출처 표시 없이 연구에 사용하거나 자신이 이미 발표한 연구를 중복하여 발표하는 행위를 말한다.
   • 4)
     "부당한 저자 표시"는 연구내용 또는 결과에 대하여 학술적 공헌 또는 기여를 한 사람에게 정당한 이유 없이 논문저자 자격을 부여하지 않거나, 학술적 공헌 또는 기여를 하지 않은 자에게 감사의 표시 또는 예우 등을 이유로 논문저자 자격을 부여하는 행위를 말한다.
2. 제보자라 함은 연구부정행위를 인지한 사실 또는 관련 증거를 대한통증학회에 알린 자를 말한다.
3. 피조사자라 함은 제보 또는 학회의 인지에 의하여 연구부정행위의 조사대상이 된 자를 말한다.
4. 본조사라 함은 부정행위의 혐의에 대한 사실 여부를 입증하기 위한 절차를 말한다.
5. "판정"이라 함은 조사결과를 확정하고 이를 제보자와 피조사자에게 문서로써 통보하는 절차를 말한다.

3. 제보자 보호와 비밀유지에 관한 사항
4. 연구윤리 위반 검증, 검증결과처리와 후속조치에 관한 사항

6. 기타 위원회 위원장이 부의하는 사항
7. 본인 또는 타인의 부정행위의 의혹에 대한 조사를 고의로 방해하거나 제보자에게 위해를 가하는 행위
8. 의학계에서 통상적으로 용인되는 범위를 심각하게 벗어난 행위

1. 위원회는 편집위원과 학술위원에서 선임하며 7인 이상으로 구성한다.
2. 위원장은 위원회를 대표하며, 편집이사로 한다. 위원장과 위원의 임기는 당해 직책의 임기와 동일하다.
3. 위원회의 제반업무를 처리하기 위해 위원 중에서 간사 1인을 둘 수 있으며, 간사는 위원장이 지명한다.
4. 위원장은 위원회의 의견을 들어 별도의 전문위원을 위촉할 수 있다.

1. 위원장은 필요한 경우 회의를 소집하고 그 의장이 된다.
2. 회의는 특별한 규정이 없는 한 재적위원 과반수 출석과 출석위원 과반수 찬성으로 의결한다. 단, 위임장은 위원회의 성립에 있어 출석으로 인정하되 의결권은 부여하지 않는다.
3. 위원회에서 필요하다고 인정할 때에는 관계자를 출석하도록 하여 의견을 청취할 수 있다.
4. 회의는 비공개를 원칙으로 한다.
5. 조사대상 연구에 관련된 위원은 해당 회의에 참여할 수 없다.

1. 위원회는 조사과정에서 제보자, 피조사자, 증인, 참고인에 대하여 출석과 자료 제출을 요구할 수 있다.
2. 피조사자가 정당한 이유 없이 출석 또는 자료 제출을 거부할 경우에는 혐의 사실을 인정한 것으로 추정할 수 있다.
3. 위원회는 연구기록이나 증거의 멸실, 파손, 은닉 또는 변조 등을 방지하기 위하여 그에 상당한 조치를 취할 수 있다.
4. 위원회 위원은 심의와 관련된 제반 사항에 대하여 비밀을 준수하여야 한다.

1. 제보자는 대한통증학회 사무국 또는 편집위원회 사무국에 직접 또는 전화, 서면, 전자우편 등으로 제보할 수 있으며 실명으로 제보해야 한다. 단, 익명의 제보라 하더라도 서면 또는 전자우편으로 논문명(또는 연구과제명)과 구체적인 부정행위의 내용과 증거를 포함하여 제보한 경우는 이를 실명제보에 준하여 처리하도록 한다.

1. 위원회는(위원장은) 구체적인 제보가 있거나 상당한 의혹이 있을 경우에는 신고 접수일로부터 30일 이내에 부정행위의 의혹에 대하여 조사할 필요가 있는지 여부를 결정하기 위한 예비조사에 착수하여야 하며, 예비조사 결과 피조사자가 부정행위 사실을 모두 인정한 경우에는 본조사 절차를 거치지 않고 바로 판정을 내린다.
2. 본조사는 부정행위의 사실 여부를 입증하기 위한 절차를 말하며, 제 5조의 규정에 따라 조사위원회를 구성하여 진행하여야 한다. 제보자와 피조사자의 이의제기 또는 변론 내용과 그에 대한 처리결과는 조사결과 보고서에 포함되어야 한다.

1. 위원회는 제보자, 피조사자, 증인, 참고인에 대하여 진술을 위한 출석을 요구할 수 있으며, 이 경우 피조사자는 이에 반드시 응해야 한다. 당사자가 이에 응하지 않을 경우에는 이의가 없는 것으로 간주한다.
2. 위원회는 피조사자에게 자료의 제출을 요구할 수 있으며, 증거자료의 보전을 위하여 해당 연구기관장의 승인을 얻어 부정행위 관련자에 대한 해당 연구자료의 압수, 보관 등을 할 수 있다.

1. 어떠한 경우에도 제보자의 신원을 직접, 간접적으로 노출시켜서는 안 되며, 부정행위 여부에 대한 검증이 완료될 때까지 피조사자의 명예나 권리가 침해되지 않도록 주의하여야 한다.
2. 조사와 관련된 일체의 사항은 비밀로 하며, 조사에 직접, 간접적으로 참여한 자는 조사와 직무수행 과정에서 취득한 모든 정보를 부당하게 누설해서는 안 된다. 다만, 합당한 공개의 필요성이 있는 경우, 위원회의 의결을 거쳐 공개할 수 있다.

위원회는 연구윤리 위반으로 제보된 피조사자에게 이의 제기 및 충분한 소명기회를 제공해야 한다.

1. 위원회는 예비조사 착수 이후 판정에 이르기까지의 모든 조사 일정은 2개월 이내에 종료한다.
2. 연구부정행위의 판정은 재적위원 과반수 출석과 출석위원 3분의 2 이상의 찬성으로 판정한다.

1. 연구부정행위 확인판정이 있는 경우 위원회는 이사회의 인준을 받아 다음 각호의 제재를 가하거나 이를 병과할 수 있다.
   • 1)
     부정행위에 대한 견책과 경고의 서한 발송
   • 2)
     해당 기관장 혹은 연구비 지원 기관에게 공식적 서한 발송
   • 3)
     본 학회지에 저자명, 논문명, 논문수록 권(호), 취소일자, 취소이유 등을 포함하는 고지의 글 게재
   • 4)
     게재된 논문은 본 학회지와 색인기관에서 삭제 및 무효화
   • 5)
     위반에 책임이 있는 저자 개인, 연구진, 혹은 연구기관에 일정기간(책임저자 3 년, 기타 1년) 원고 투고금지 조치
   • 6)
     위원회는 본 학회의 연구윤리와 관련하여 고의 또는 중대한 과실로 진실과 다른 제보를 하거나 허위의 사실을 유포한 자에 대해서는 회원자격을 박탈 또는 정지할 수 있다.

위원장은 조사결과에 대한 위원회의 결정을 서면으로 작성하여 지체 없이 제보자 및 피조사자 등 관련자에게 이를 통지해야 한다.

피조사자 또는 제보자는 위원회의 결정에 불복할 경우 제16조의 통지를 받은 날로부터 14일 이내에 서면으로 위원회에 재조사를 요청할 수 있다.

조사결과 연구부정행위가 없었던 것으로 확정될 경우, 위원회는 피조사자의 명예회복을 위해 노력하며 적절한 후속조치를 취할 수 있다.

1. 조사와 관련된 기록은 조사 종료 시점을 기준으로 5년간 보관하여야 한다.
2. 판정이 끝난 이후의 결과는 학회 상임이사회에 보고 해야 하며, 제보자, 조사위원, 증인, 참고인, 자문에 참여한 자의 명단 등 신원과 관련된 정보에 대해서는 당사자에게 불이익을 줄 가능성이 있을 경우에 위원회의 결의로 공개대상에서 제외할 수 있다.

본 규정은 2008년 10월 1일부터 시행한다.

제보의 접수일로부터 만 5년 이전의 부정행위에 대해서는 이를 접수하였더라도 처리하지 않음을 원칙으로 한다.

대한통증학회는 회원을 대상으로 연구자가 연구 수행 과정에서 준수해야 할 연구윤리 규범, 부정행위의 범위, 부정행위에 대한 대응 방법 및 검증 절차 등에 관하여 연 1회 교육을 실시한다.

본 규정에 규정되지 아니한 사항은 대한의학학술지편집인협의회에서 제정한 의학논문 출판윤리 가이드라인(http://kamje.or.kr/publishing_ethics.html)을 따른다.

1. "Unfair research activities" refer to forging, falsifying, plagiarizing research content, including inappropriate authors, by intention or mistake, regardless of research objectives in the process of proposing, performing, and publishing the research, as follows.
   • 1)
     "Forging" means reporting the research data or results, etc. that do not really exist but have been fabricated.
   • 2)
     "Falsifying" means distorting research contents or results by changing research data, processes, and results dishonestly.
   • 3)
     "Plagiarizing" means using the research ideas, processes, results, etc. of any other person without citing the source. It is also considered plagiarism if an author publishes his or her own research results repeatedly.
   • 4)
     "Inappropriate authors" means to include an individual's name as author who has not contributed significantly to either the research or contents of a paper as a token of gratitude or for reason of honorable treatment, etc. or to not grant authorship to a person who has academically contributed to research contents or results.an activity of not granting a title of an author, without right reason, to any other person that academically contributed to research contents or results or of granting a title of an author, as a token of gratitude or for the reason of honorable treatment etc, to any other person that did not academically contribute to them.
2. An informant means a person who has informed the Society of the facts or evidence regarding unfair research activities.
3. An examinee means a person who has become a target of examination regarding unfair research activities based on information from an informant or the Society's recognition.
4. The main examination means a procedure to prove whether the suspicion for any unfair research activity is true or not.
5. "Judgment" means a procedure to determine examination results and to communicate the results to the informant and the examinee in written form.

1. Establishment of research ethics;
2. Prevention and examination of unfair research activities, and examination;
3. Protection of informants and maintenance of confidentiality;
4. Verification of research ethics violation, determination of appropriate action, and implementation of follow-up measures;
5. Measures to restore examinees' honor;
6. Other matters presented by the Committee chairman for discussion;
7. Protection of informant's rights and reputation from punitive action by anyone.;
8. Activities generally not permitted in the medical community.

1. The Committee shall be appointed from seven (7) or more publishing commissioners and academic commissioners.
2. The chairman shall represent the Committee and be a publishing director. His or her office term shall be the same as that of the publishing director.
3. One secretary may be appointed to assist in all activities of the Committee and shall be designated by the chairman.
4. The chairman may appoint expert commissioners as needed, following advice of the Committee.

1. The chairman will convene and preside over meetings as needed.
2. Unless there is any special exception, the majority of commissioners will be required to attend each meeting. A decision will be made by a majority vote of the commissioners attending the meeting. The chairman is required to attend all meetings and may be considered in counting a majority of members. However, the chairman may not vote in making decisions.
3. When necessary, the Committee may ask the person concerned to attend the meeting and express his or her opinions.
4. In principle, the meeting shall not be disclosed.
5. A commissioner being investigated shall not attend the meeting.

1. The Committee may ask informants, examinees, witnesses, and other persons to attend and submit materials.
2. If an examinee refuses to attend a meeting or to submit materials without reasonable explanation, it may be determined to be an admission of guilt.
3. The Committee may take appropriate measures to prevent the destruction, concealment, or falsification etc. of the research records or evidence relevant to the case.
4. A commissioner shall keep the matters relating to deliberation confidential.

1. An informant may report any unfair research activity to the Society Secretariat or the Publishing Committee Secretariat personally, by phone, in written form, by email, etc. He or she shall give his or her real name, but even an anonymous report shall be regarded as a real-name one, if it includes a title of an article (a research project) and specific contents and evidence of the unfair activity in written form or by email.

1. In case of any specific report or considerable suspicion of an unfair activity, the Committee (chairman) shall begin a preliminary investigation to decide whether it is necessary to investigate the suspicious activity within thirty (30) days from the date on which the report is received. The Committee may pass judgment immediately without a main investigation procedure, if an examinee admits to the charge.
2. The main investigation, which means a procedure to prove whether the charge is true or not, shall be performed by the investigation Committee organized in accordance with the provisions of Article 5. The report on investigation results shall include the objections or pleadings of an informant and an examinee and their Committee's results.

1. The Committee may ask an informant, an examinee, a witness, and other persons to attend a meeting to state their opinions. In this case, the examinee must comply with the request. If the person concerned does not comply with the request, the Committee shall consider them to be in agreement with the case.
2. The Committee may ask the examinee to submit materials relevant to the case. The Committee will possess and secure the materials with the approval of the research institution involved.

1. The identity of an informant shall not be disclosed directly or indirectly in any case. Attention shall be paid to the protection of the honor and rights of an examinee until a judgement has been reached by the Committee.
2. All the matters under investigation shall be kept confidential, and any person that participates in the investigation directly or indirectly shall not reveal the information acquired during the investigation and the performance of their duties related to the case. However, if there is any necessity for reasonable disclosure, information may be disclosed upon approval by the Committee.

The Committee shall give sufficient opportunities for objections and explanations to an examinee that has been charged with a violation of research ethics.

1. The Committee shall complete all the procedures of investigation from a preliminary investigation to judgment within two (2) months.
2. Judgement of ethics violations shall be rendered at a meeting of a majority of the Committee members with an approval of at least 2/3 of the commissioners present.

1. If the suspicion of the ethics violation is judged to be true, the Committee may apply one or more sanctions to the person concerned with the approval of the Board of Directors as follows:
   • 1)
     Reprimand and sending of a warning letter;
   • 2)
     Sending of an official letter to the director of the organization involved or the research funding organization;
   • 3)
     Publishing of a notice to cancel the article including author's name, article title, volume (No.) of the journal involved, date and reasons of cancellation, etc.;
   • 4)
     Deletion and nullification of the article involved from the journal and the indexing organization;
   • 5)
     Prohibition for the author, the research team, or the research organization responsible for the violation to contribute manuscripts for certain periods (chief author: three years; other authors: one year);
   • 6)
     The Committee may deprive a person of his or her membership in the Society if the person intentionally or erroneously gives an untrue report or makes a false accusation regarding the research ethics of another researcher.

The Chairman shall immediately send written notification of the decision of the Committee to the persons concerned, including the informant and the examinee.

The examinee or the informant may appeal the Committee's decision in writing within fourteen (14) days from the date on which he or she receives the notification of the Committee's decision.

If the examinee is found innocent of ethics violation, the Committee may take appropriate follow-up measures, to restore the honor of an examinee.

1. The records relating to investigations shall be kept for five (5) years from the date on which the investigation is finished.
2. At the conclusion of a case, the judgement shall be reported to the Standing Board of Directors of the Society. If the Committee concludes that it may cause harm to the participants, it may resolve to keep their identities confidential.

These regulations shall be in effect beginning October 1, 2008.

Ethics violations that occurred five (5) years prior to the date of the report of the violation will not be addressed. The Committee may consider exceptions of unusual merit.

The Society will provide education once per year on the standards of research ethics This training will include information regarding the scope, countermeasures, and verification procedures of ehtics violations.

Matters unstipulated in these regulations shall follow the medical paper publication ethics guidelines formulated by the Korean Association of Medical Journal Editors (KAMJE) (See (https://www.kamje.or.kr/board/view?b_name=bo_publication&bo_id=13&per_page=)'.
